OVERVIEW
Welcome to The Rustic Treehouse! The terms "we", "us" and "our" refer to The Rustic Treehouse. We operate this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the "Services"). The Rustic Treehouse is powered by Shopify, which enables us to provide the Services to you.
By visiting, interacting with, or using our Services, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms or Privacy Policy, you should not use or access our Services.
SECTION 1 — ACCESS & ACCOUNT
By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. To use our Services you may be asked to provide information such as your email address, billing, payment, and shipping information. You represent and warrant that all information you provide is correct, current, and complete.
You are solely responsible for maintaining the security of your account credentials and for all account activity. You may not transfer, sell, assign, or license your account to any other person.
SECTION 2 — OUR PRODUCTS
The Rustic Treehouse specializes in custom laser-engraved and personalized products including tumblers, coasters, pens, and other engravable items. All products are made-to-order and personalized specifically for each customer.
By placing an order, you acknowledge that:
- You are responsible for the accuracy of all custom text, names, dates, and personalization details submitted at checkout
- We engrave exactly what you provide — errors in submitted information cannot be corrected after production begins
- Personalized items cannot be returned or exchanged unless the error was made on our end
- Colors or product appearance may differ from how they appear on your screen due to device settings and configuration
All product descriptions are subject to change at any time without notice. We reserve the right to discontinue any product at any time.
SECTION 3 — ORDERS
When you place an order, you are making an offer to purchase. The Rustic Treehouse reserves the right to accept or decline your order for any reason at its sole discretion, including but not limited to:
- A product is listed at an incorrect price due to a typographical error
- Payment cannot be verified or is declined
- We suspect fraudulent activity
- An order violates these Terms of Service
Your order is not accepted until The Rustic Treehouse confirms acceptance. Because production begins immediately upon acceptance, we are unable to accommodate cancellation or modification requests after an order is placed. If your order is cancelled after payment has been processed, you will receive a full refund to your original payment method.
SECTION 4 — PRICES & BILLING
All prices are listed in U.S. dollars and are subject to change without notice. The price charged for an order will be the price displayed at the time the order is placed and will be set out in your order confirmation email.
You represent and warrant that: (i) the credit card or payment information you provide is true, correct, and complete; (ii) you are duly authorized to use such payment method; (iii) charges incurred by you will be honored by your payment provider; and (iv) you will pay all charges including shipping and applicable taxes.
Sales tax will be applied to orders where required by law based on the delivery address.
SECTION 5 — PRODUCTION & SHIPPING
All orders require up to 3 business days of production time before shipment. Orders placed on weekends or holidays begin processing the next available business day.
Selecting an expedited shipping option at checkout does not shorten production time. UPS Next Day Air Saver delivers the next business day after production is complete — it does not bypass the production period.
Once we transfer your order to the carrier, title and risk of loss passes to you. We are not liable for shipping delays, losses, or damages caused by shipping carriers once an order has been handed off for delivery. For full details, please refer to our Shipping Policy.
SECTION 6 — RETURNS & REFUNDS
Due to the personalized nature of our products, all sales are final. We do not accept returns or exchanges for buyer's remorse or incorrect information submitted by the customer at checkout.
If an item arrives with a defect or error caused by us, we will provide a free replacement at no cost to you. Requests must be submitted within 7 days of delivery by emailing joslyn@therustictreehouse.com with your order number and clear photos of the item showing the error or defect.

SECTION 7 — INTELLECTUAL PROPERTY
Our Services, including all trademarks, text, images, graphics, product designs, video, and audio, are owned by The Rustic Treehouse or its licensors and are protected by U.S. and foreign intellectual property laws. You may not reproduce, distribute, modify, or transmit any material from our Services without our prior written consent.
By submitting personalization text or content for engraving, you represent that you have the right to use that content and that it does not infringe on the intellectual property rights of any third party.
SECTION 8 — THIRD-PARTY LINKS & TOOLS
Our Services may contain links or access to third-party websites and tools. We are not responsible for the content, accuracy, or practices of any third-party sites or tools. Any use of optional third-party tools is entirely at your own risk. Complaints or concerns regarding third-party products and services should be directed to the third party.
SECTION 9 — RELATIONSHIP WITH SHOPIFY
The Rustic Treehouse is powered by Shopify, which enables us to provide our Services to you. However, any sales and purchases you make in our store are made directly with The Rustic Treehouse. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and The Rustic Treehouse. You expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with The Rustic Treehouse.
SECTION 10 — PRIVACY POLICY
All personal information we collect through the Services is subject to our Privacy Policy. Because our Services are hosted by Shopify, Shopify also collects and processes certain personal information about your access to and use of the Services. By using the Services, you acknowledge that you have read and agree to our Privacy Policy.
SECTION 11 — FEEDBACK
If you submit any ideas, reviews, suggestions, or other feedback, you grant us a perpetual, worldwide, royalty-free license to use, reproduce, modify, publish, and distribute such feedback for any purpose, including to operate and improve our Services. We are under no obligation to maintain your feedback in confidence or compensate you for it.
You agree that your feedback will not violate any third-party rights and will not contain unlawful, abusive, or harmful content.
SECTION 12 — ERRORS, INACCURACIES & OMISSIONS
Occasionally there may be information on the Services that contains typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, shipping charges, transit times, or availability. We reserve the right to correct any errors or inaccuracies and to change or update information at any time without prior notice, including after an order has been submitted.
SECTION 13 — PROHIBITED USES
You may access and use the Services for lawful purposes only. You may not use the Services for any unlawful purpose, to violate any regulations or laws, to infringe on intellectual property rights, to harass or harm any person, to transmit false or misleading information, to send spam or unsolicited communications, or to engage in any conduct that restricts others from using the Services.
You also agree not to upload viruses or malicious code, collect personal information of others, use automated tools or AI agents to scrape or access the Services, or interfere with the security features of the Services. We reserve the right to suspend or terminate your access at any time for violations of these Terms.
SECTION 14 — DISCLAIMER OF WARRANTIES
THE SERVICES AND ALL PRODUCTS OFFERED THROUGH THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT ANY REPRESENTATION, WARRANTIES, OR CONDITIONS OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ALL IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, DURABILITY, TITLE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE THAT YOUR USE OF THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
SECTION 15 — LIMITATION OF LIABILITY
TO THE FULLEST EXTENT PROVIDED BY LAW, THE RUSTIC TREEHOUSE, OUR PARTNERS, DIRECTORS, OFFICERS, EMPLOYEES, AFFILIATES, AGENTS, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES OF ANY KIND, INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR REPLACEMENT COSTS, ARISING FROM YOUR USE OF THE SERVICES OR ANY PRODUCTS PURCHASED THROUGH THE SERVICES. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT PAID FOR THE ORDER IN QUESTION.
SECTION 16 — INDEMNIFICATION
You agree to indemnify, defend, and hold harmless The Rustic Treehouse, Shopify, and our affiliates, officers, directors, employees, agents, and service providers from any losses, damages, liabilities, or claims, including reasonable attorneys' fees, arising out of: (1) your breach of these Terms of Service; (2) your violation of any law or the rights of a third party; or (3) your access to and use of the Services.
SECTION 17 — TERMINATION
We may terminate this agreement or your access to the Services at any time without notice at our sole discretion. You will remain liable for all amounts due up to and including the date of termination. Sections relating to Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law will survive any termination.
SECTION 18 — SEVERABILITY
If any provision of these Terms of Service is determined to be unlawful, void, or unenforceable, that provision shall be enforced to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed severed from these Terms. Such determination shall not affect the validity and enforceability of any other remaining provisions.
SECTION 19 — WAIVER & ENTIRE AGREEMENT
The failure of us to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. These Terms of Service, together with our Shipping Policy, Return & Refund Policy, and Privacy Policy, constitute the entire agreement between you and The Rustic Treehouse and govern your use of the Services, superseding any prior agreements or communications.
SECTION 20 — GOVERNING LAW
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas. You and The Rustic Treehouse consent to the exclusive venue and personal jurisdiction of the courts located in Bexar County, Texas for any disputes arising under these Terms.
SECTION 21 — CHANGES TO TERMS
We reserve the right to update or modify these Terms of Service at any time by posting updates to this page. It is your responsibility to review these Terms periodically. Your continued use of the Services following any changes constitutes your acceptance of the updated Terms.
